Expert committee of the city of Hof

The tasks

Pursuant to Section 192 (1) of the German Building Code (BauGB), independent expert committees are to be formed for the determination of land values and for other valuations.

The expert committees are responsible for the following tasks in particular:

  • Preparation of expert opinions on the market value of developed and undeveloped land as well as rights to land
  • Maintaining and evaluating the collection of purchase prices
  • Determination of standard land values

The honorary members of the independent expert committee for the area of the district-free city of Hof have special expertise in the field of real estate valuation due to their professional activity and experience.

Office of the expert committee

The expert committee uses an office to prepare its work. The office conducts the business of the expert committee in accordance with the instructions of the chairman.

The duties of the office of the expert committee also include the determination and publication of standard land values, the provision of information on standard land values, the provision of information from the purchase price collection (if the person requesting the information has a legitimate interest) and the determination and publication of other valuation data.

Market value appraisal

Upon request, the appraisal committees prepare appraisals on the market value of developed and undeveloped properties and also on rights encumbering properties.

Fees and expenses are charged for the preparation of an expert opinion in accordance with Section 15 of the Ordinance on Expert Committees. The amount of the fee is essentially based on the amount of the market value determined.

Appraisals can be requested in writing using the forms provided.

Collection of purchase prices

In the collection of purchase prices, contracts in which someone undertakes to transfer ownership of a plot of land in return for payment, including by way of exchange, or in which a heritable building right is granted for the first time or again, are expertly evaluated on the basis of the associated building files and development plans.

The contracts are recorded anonymously by means of an EDP system in compliance with data protection and processed automatically.

In most cases, the purchase contract contains only a lump-sum statement of the purchase price. However, this is usually influenced by circumstances and value characteristics that are not apparent from the purchase contract; but only with additional information from the questionnaire can the appraisal committee fulfill the tasks assigned to it.

There is a legal obligation for the property owner or acquirer to provide information to the expert committee in accordance with § 197 Paragraph 1 BauGB.

The collection of purchase prices including the transmitted documents may only be inspected by the members of the expert committee and the employees of the office exclusively for the performance of their duties.

Information may only be provided if it is necessary for the purpose of the valuation and if a justified interest is proven. Furthermore, property-related information may only be provided subject to certain conditions. In particular, the name and address of the owners and other persons may not be disclosed.

As a rule, the existence of a justified interest is to be assumed if the information is provided by

  1. authorities concerned with the valuation of real property,
  2. publicly appointed and sworn experts who are concerned with the valuation of real property or
  3. experts for the valuation of real property with certification by a body accredited for this purpose under the Accreditation Body Act in accordance with DIN EN ISO/IEC 17024

is applied for a valuation (§ 11 Gutachterausschussverordnung BayGaV).

Standard ground values

The city of Hof's appraisal committee prepares a standard value map based on the data from the purchase price collection.

The standard value map (M. = 1:10,000) shows the standard land values for areas with essentially the same usage and value conditions.

In built-up areas, standard land values are to be determined using the value that would result if the land were undeveloped.

The BORIS-Bayern portal (www.boris-bayern.de) provides round-the-clock access to standard land values for a fee.
